Huzzler – Terms of Service

1. Eligibility

• Users must be 13+ years old. Under 18 must use a parent/guardian account.
• Provide accurate registration information and protect login credentials.
• All activity under your account is your responsibility.

2. User Roles

Freelancers

• Work independently; Huzzler does not employ or supervise you.
• Deliverables (“Work Product”) belong to you until payment is completed.
• Comply with IP laws, ethics, and applicable Indian laws.

Clients

• Post clear and truthful project details.
• Pay Freelancers directly; Huzzler does not handle payments.
• Respect Freelancer IP and confidential information.

All Users

• Follow applicable laws, IT Rules 2021, DPDP Act 2023.
• Do not post illegal, offensive, harmful, or infringing content.

3. Platform Nature

• Huzzler is an online intermediary connecting Freelancers and Clients.
• We do not guarantee work quality, payment, or outcomes.
• All IP rights and contractual obligations are between the Freelancer and Client.

4. Payments & Transactions

• All payments and contracts occur outside the Platform.
• Users are responsible for taxes, GST, TDS, invoices, and refunds.
• Huzzler is not a payment processor or guarantor.

5. Intellectual Property

• Users retain ownership of uploaded content (profiles, images, portfolios).
• Uploading content grants Huzzler a non-exclusive, royalty-free license to host and display it.
• Freelancer Work Product rights transfer to Client after full payment, unless otherwise agreed.
• Do not upload third-party content without permission.

6. Prohibited Activities

• No illegal, offensive, pornographic, violent, or infringing content.
• No misrepresentation or impersonation.
• No spamming, soliciting free work, bypassing Platform fees, or fraud.
• No interference with Platform systems or scraping data.

7. Content Responsibility

• Users are fully responsible for all content they post.
• Huzzler does not endorse or verify user content.
• Unlawful content will be removed upon valid notice as per IT Rules, 2021.

8. Limitation of Liability

• Huzzler is not liable for disputes, unpaid fees, IP claims, or damages.
• Maximum liability is INR 1,000 or fees paid in the last 3 months, whichever is lower.
• Users indemnify Huzzler for claims arising from their activity.

9. Termination

• Accounts may be suspended/terminated for ToS violations or illegal activity.
• Users can deactivate their account anytime.
• Termination does not affect obligations between Freelancers and Clients.

10. Privacy & Data

• Personal data is handled according to our Privacy Policy.
• Users consent to lawful collection, storage, and processing for operations and compliance.
• Users may access, update, or delete their data.

11. Dispute Resolution

• Resolve disputes amicably first.
• If unresolved, mediation under the Mediation Act, 2023 in Chennai, Tamil Nadu.
• Remaining disputes go to arbitration under Arbitration & Conciliation Act, 1996, seat in Chennai, Tamil Nadu.

13. Updates

We may update these Terms. Continued use indicates acceptance of the updated Terms.
